It is worth noting the O.C.G.A. 12-8-26(a) Disposal Facility Siting Decision states: Whenever any county, municipality, group of counties, or authority begins a process to select a site for a municipal solid waste disposal facility must first call at least one public meeting to discuss waste management needs of the local government or region and to describe the process of siting facilities to the public.
This was adopted into our County's Solid Waste Managemente Plan Section 9.7.2 which states: No proposed facility or facility expansion will be sited in the County without a letter from the County Commission stating that a facility is consistent with the Solid Waste Management Plan. The County Commission will hold at least one public hearing to gather input to make this determination.

The Applicant has been working with consultation company "Atlantic Coast consulting (ACC)", out of Roswell and Savannah Georgia. ACC composed the Application submitted to the Planning & Developmente Commission.

EVALUATION OF PROPERTY INTRODUCTION
The Application states the ACC has completed a preliminary site evaluation of the Applicant's 518 acre tract of land in hopes of getting it developed into a Regional Municipal Solid Waste (MSW) Landfill. In the very first paragraph we are told that not only do they intend to develope a MSW landfill but also a Construction & Debri (C&D) Landfill. The facility is suppose to include separate containers for recyclables and the option of a composting operation. In addition, future development of the Subject Property will likely include the development o f a landfil gas-to-energy facility to utilize the landfill gas as a source of energy and to reduce the carbon emissions from the facility. The Application makes no other reference to the location or requirements of a C&D landfill being developed on this specific property.
According to the the Environmental Protection Division (EPD) of Georgia "Circular 14", the following criteria for a landfill site acceptability permit must be addressed.
ZONING: The site must conform to all local zoning and land use ordinances. Written verification must be usbmitted to the Divsion by the Applicant demonstrating that the proposed site complies with local zoning and land use ordinances. This verification shall include a letter from the local governmental authority stating that the proposed site complies with local zoning or land use ordinances. This verification shall be provided at the time of submission of a permit application and reaffirmed by the governmental authority prior to permit issuance. The Application states: To develope a solid waste management facility on the property will require that the property be rezoned to a Heavy Industrial (i-2) Zoning District. In Addition, a petition requesting a conditional use will have to be filed....One of the conditions limits the height of a landfill cell to sixty (60) feet above original grade. if a variance from this limitation can not be obtained, the feasibility of developing a landfill may be in question."
